1. Who we are

For information relating to our own website, enquiries, customer relationships, business administration and similar activities, Social Media Network Ltd trading as TalkMera generally acts as the data controller. For some customer services, particularly WhatsApp automation and integrations, we may process personal information on behalf of a business customer. In those circumstances, the customer may be the controller and TalkMera may act as a processor.

2. Information we may collect

Website and enquiry information

When you contact us or submit an enquiry, we may collect your name, business name, work email address, telephone number, country, website address, preferred contact method, information you provide about your requirements, and correspondence with TalkMera.

Customer and account information

If your business becomes a customer, we may process authorised-user details, organisation details, service configuration, contractual and billing information, support correspondence and service history.

WhatsApp and workflow information

Where TalkMera provides WhatsApp automation or integration services, the information processed depends on the workflow. It may include telephone numbers, names or identifiers, message content and metadata, timestamps, message status information, workflow events, enquiry information, documents or attachments where required, and information exchanged with connected business systems.

Technical and security information

We may process IP addresses, browser and device information, timestamps, authentication events, server and application logs, webhook and integration events, error information, security events and audit information needed to operate, protect and troubleshoot the service.

3. How we use personal information

We may use personal information to respond to enquiries, discuss prospective services, manage customer relationships, provide and support TalkMera services, operate integrations, troubleshoot problems, maintain security, manage billing, keep appropriate business records, comply with legal obligations and establish, exercise or defend legal claims.

4. Lawful bases

Depending on the activity, we may rely on contract, legitimate interests, legal obligation or consent. We do not treat consent as the default lawful basis for every activity.

5. Customer-controlled WhatsApp and automation data

Where TalkMera acts as a processor, the TalkMera customer normally determines the purpose of the processing and is responsible for establishing an appropriate lawful basis. TalkMera processes the information according to documented instructions and the applicable agreement.

6. Sensitive information

TalkMera does not ask website visitors to provide special-category or other particularly sensitive personal information through general enquiry channels. If a legitimate customer workflow requires such information, the relevant legal, contractual, security and technical requirements should be assessed before implementation.

7. AI services

Some agreed workflows may use AI to assist with classification, extraction, summarisation, response assistance, routing or internal staff workflows. We aim to provide AI services only with the information reasonably required for the particular task. Third-party AI providers, if used in production, will be documented when the actual architecture is chosen.

8. How we share personal information

We may share information with service providers that help us operate TalkMera, with customer-authorised systems, where required by law, or where necessary to protect systems and legal rights. Service providers should receive only the information reasonably required for their role.

Current public-site infrastructure providers

  • Unlimited Hosting (unlimitedhosting.co.uk) — UK cPanel web hosting for the public website.
  • Cloudflare — DNS, proxy, TLS, content delivery and security-related services.

These providers may process technical information required to deliver and protect the website. Future TalkMera application subprocessors are not yet fixed and will be documented only after the actual production architecture is chosen.

9. Meta and WhatsApp

TalkMera services may integrate with the WhatsApp Business Platform and other services operated by Meta. Meta and WhatsApp operate their own platforms and may process information according to their applicable terms and privacy policies. TalkMera does not control processing carried out independently by those platforms.

10. International transfers

TalkMera is a UK business, but some infrastructure or service providers may process information outside the United Kingdom. Where UK data-protection rules relating to international transfers apply, we will use an appropriate lawful transfer mechanism.

11. Retention

We do not intend to keep personal information indefinitely. Retention depends on why the information was collected, whether an active customer relationship exists, contractual and operational requirements, customer instructions where TalkMera acts as a processor, legal requirements, security needs and potential legal claims.

12. Security

TalkMera aims to apply technical and organisational measures appropriate to the service and risks involved. Depending on the system, these may include access controls, least-privilege access, encryption, HTTPS, credential protection, customer separation, audit logging, monitoring, backups, security updates, restricted administration and data minimisation.

13. Your rights

Depending on the circumstances and lawful basis involved, you may have rights including access, correction, deletion, restriction, objection, data portability and withdrawal of consent. These rights are not absolute in every circumstance. To exercise a right, email hello@talkmera.com.

14. When TalkMera is acting for another business

If your information has been processed through a TalkMera workflow operated for another business, that business may be the controller responsible for your information. In those circumstances, you should generally direct requests concerning that business's use of your information to that organisation.

15. Marketing communications

Where we send marketing communications, we will do so only where permitted by applicable law. You can ask us to stop marketing communications at any time.

16. Cookies and analytics

We do not currently use optional analytics or advertising tracking on the public TalkMera website. In particular, Google Analytics and Meta Pixel are not currently implemented. Our website and infrastructure providers may use technologies that are necessary for site operation, security, network delivery or user preferences. If non-essential analytics or advertising technologies are introduced later, we will update this policy and obtain consent where required.

17. Children's information

TalkMera's website and direct commercial services are primarily intended for businesses and are not designed as services for children. If a proposed customer workflow is likely to process children's personal information, additional legal, privacy and safeguarding considerations should be assessed before implementation.

18. Data deletion

You can ask us to delete personal information where the right to erasure applies. See our Data Deletion page or email hello@talkmera.com.

19. Complaints

If you have concerns about how TalkMera has handled your personal information, contact us first so we can investigate. You also have the right to make a complaint to the UK's Information Commissioner's Office (ICO).

20. Changes to this policy

We may update this policy when our services, technology, service providers or legal requirements change. The latest version will be published on this website with an updated revision date.
